1. Purpose
These terms and conditions govern the use of the Ignis Umbra graphics pack (hereinafter “the Pack”), intended for use with the game Assetto Corsa. By downloading, installing or using the Pack, you unconditionally accept the terms and conditions set out below.
2. Intellectual property
The Pack is an original work, created and developed in its entirety by Ignis Graphics, which is its sole creator and holds all the intellectual property rights associated with it.
The Pack has been designed to work in conjunction with Pure, a third-party tool created by Peter Boese, the rights to which remain exclusively with its creator. Ignis Graphics claims no rights over Pure, its developments or its code: Pure remains an independent piece of software, separate from the Pack, which the user must obtain separately from its creator (see Article 5).
Any reproduction, modification, translation or use of the Pack not expressly authorised by these terms and conditions constitutes an infringement, for which the perpetrator may be held liable under civil and criminal law.
3. Exclusive distribution
AssettoShare.com is the only website and platform authorised to distribute the Pack.
Any republication, re-hosting, making available for download, sharing of direct download links, or distribution of the Pack in any form whatsoever whether in its original state or modified on another website, platform, server, forum, social media site or any other medium, is strictly prohibited without the prior written authorisation of Ignis Graphics.
This prohibition applies to any natural or legal person, whether for free or for a fee.
4. The Pack is free of charge and any payment by a third party is prohibited
The pack is made available free of charge by Ignis Graphics via AssettoShare.com.
It is strictly forbidden for any third party, whoever they may be, to:
- sell the Pack, either as it is or in a modified form;
- make its acquisition conditional upon the payment of a sum of money, in whatever form (one-off purchase, compulsory donation, subscription, paid tier, etc.);
- include the Pack in a paid offer, a commercial bundle or a subscription service;
- derive any direct or indirect remuneration from it other than that received by Ignis Graphics and AssettoShare.com under their own business model (advertising on the official website).
Any breach of this clause constitutes both an infringement of copyright and a breach of contract under these terms and conditions.
5. Contents of the Pack and any third-party tools required
The Pack consists solely of a set of settings and configuration files (Pure configuration, PP filter, ReShade presets, camera scripts, etc.) intended for use with third-party tools.
The Pack does not contain, provide or grant access to any of the external software or tools required for it to function. This includes, in particular (non-exhaustive list): Assetto Corsa, Content Manager, Custom Shaders Patch (CSP), Pure, ReShade, as well as any other third-party software required.
These tools, whether free or paid, must be obtained, purchased and downloaded separately from the Pack, directly from their respective creators or distributors, in accordance with their own terms of use and pricing conditions. Ignis Graphics and AssettoShare.com have no control over these third-party tools and accept no liability for their availability, functionality, pricing or their own terms of use.
6. Authorised use
The user is authorised to:
- download the pack from AssettoShare.com;
- install it and use it strictly for personal, non-commercial purposes whilst playing Assetto Corsa.
The user is not permitted to redistribute, resell, sub-license, modify and then republish, or commercially exploit the Pack without the prior written consent of Ignis Graphics.
7. Limitation of liability
The Pack is provided ‘as is’. Ignis Graphics and AssettoShare.com do not guarantee that it is entirely free from errors, bugs or incompatibilities with certain hardware configurations, game versions or versions of the third-party tools mentioned in Article 5. The installation and use of the Pack are the sole responsibility of the user.
8. Development and availability of the Pack
Ignis Graphics reserves the right to amend, update, suspend or withdraw the Pack at any time, without prior notice or any obligation to provide a reason.
9. Applicable law
These terms and conditions are governed by French law. Any dispute relating to their interpretation or enforcement shall fall within the exclusive jurisdiction of the French courts.
